CBP Publishes Updated Guidance on Completing Origin Documents

In a Cargo Systems Messaging Service (CSMS) bulletin published on November 19, 2024, Customs and Border Protection (CBP) issued updated guidance on the obligations and requirements for importers for completing origin documents.

This updated guidance state that origin statements or certifications of origin must be completed by a “responsible official” of the importer, exporter, producer, or by an authorized agent of the importer, exporter, or producer that has “knowledge of the relevant facts per the respective trade preference program regulations.”

CBP also reminds the trade that the party that completes the origin document is responsible “for the truthfulness of the origin declaration/statement/certification and all the information contained therein and are liable for false statements and material omissions.”

Claims for preferential tariff treatment can be denied by CBP if the importer fails to submit completed origin declaration, origin statement, or certification of origin documents that have been requested.
