CBP Announces New Aluminum Smelt and Cast Requirements, Issues Guidance

On March 10, 2023, in Cargo Systems Messaging Service (CSMS) #55438432, U.S. Customs and Border Protection (CBP) announced new requirements “for reporting the countries of smelt and cast for imports of aluminum and aluminum derivative products from all countries of origin.” This requirement is effective for goods entered for consumption or withdrawn from warehouse for consumption on or after April 10, 2023. It includes “all aluminum articles and aluminum derivative articles from all countries of origin, regardless of whether Section 232 duties, quotas, exclusions, or general approved exclusion apply.”

The change requires reporting the primary country of smelt, secondary country of smelt, and country of cast in the entry summary. The new requirement supports the addition of new Section 232 duties of 200% ad valorem on aluminum articles “where any amount of primary aluminum used in the manufacture of the aluminum articles is smelted in Russia, or the aluminum articles are cast in Russia, and derivative aluminum articles where any amount of primary aluminum used in the manufacture of the derivative is smelted in Russia, or the derivative aluminum articles are cast in Russia.” The new duty rates are also effective April 10, 2023.
