USTR Reinstates Certain Section 301 Exclusions

On March 24, 2022, in a notice, the Office of the U.S. Trade Representative (USTR) announced the reinstatement of certain exclusions for the “Section 301 investigation of China’s acts, policies, and practices related to technology transfer, intellectual property, and innovation.” 352 of the 549 exclusions that were previously extended have been reinstated from October 12, 2021, through December 31, 2022. The exclusions can be claimed under tariff 9903.88.67. U.S. Customs and Border Protection (CBP) will issue entry guidance and implementation instructions.
