President Trump Signs EO on ADD/CVD Enforcement with CBP Implementation

On March 31, 2017 President Trump issued an Executive Order (EO) regarding antidumping and countervailing duty enforcement, titled “Establishing Enhanced Collection and Enforcement of Antidumping and Countervailing Duties and Violations of Trade and Customs Laws”. The Department of Homeland Security (DHS) has designated U.S. Customs and Border Protection (CBP) as the lead force behind implementing the EO.

The EO is aimed toward combating the evasion of antidumping and countervailing duties leading to unfair competition. The EO tasks DHS with developing a plan within 90 days that identifies and requires covered importers to provide enforcement measures, “for antidumping and countervailing duty liability” including bonds and other legal methods.  

Additionally, DHS must develop a secondary plan to combat “violations of United States trade and customs laws for goods and for enabling interdiction and disposal, including through methods other than seizure, of inadmissible merchandise entering through any mode of transportation, to the extent authorized by law.”
