EPA Issues Final Rule on Hydrofluorocarbons

On October 24, 2023, the Environmental Protection Agency (EPA) published a final rule that outlines restrictions on the use of hydrofluorocarbons (HFCs) in specific industries. Additionally, the final rule establishes “a process for submitting technology transitions petitions; establishes recordkeeping and reporting requirements; and addresses certain other elements related to the effective implementation of the American Innovation and Manufacturing Act [AIM Act].”

The AIM Act was passed in 2020 and authorized the EPA to regulate HFCs by phasing down production through an allocation program, promote reclamation and minimize releases of HFCs, and facilitate adaptation and transitions to next-generation technologies. Reporting, recordkeeping, and labeling requirements will be used to “inform EPA of the transitions that are occurring in those sectors and subsectors addressed by this rule.”

This final rule is effective December 26, 2023. The required date of compliance for the HFC restrictions will vary between each industry between January 1, 2025, and January 1, 2028.
