DDTC Implements New ITAR Exemption

On December 30, 2025, the Department of State's Directorate of Defense Trade Controls (DDTC) issued a final rule in the Federal Register that amends the International Traffic in Arms Regulations (ITAR) to "facilitate defense trade and cooperation among Australia, the United Kingdom, and the United States."

Among other things, the final rule establishes a new license exemption for "export, reexport, retransfer, or temporary import of defense articles, the performance of defense services, or engaging in brokering activities between or among Authorized Users within the physical territory of Australia, the United Kingdom". Accompanying the exemption is a new "Excluded Technology List" which specifies items and services "ineligible for transfer" under the exemption.

The final rule took effect on December 30, 2025.
