Census Proposes DDTC EEI Filing Requirement

On May 3, 2023, the U.S. Census Bureau (Census) issued a Notice of Proposed Rulemaking to reflect export reporting requirements for the Department of State’s Directorate of Defense Trade Controls (DDTC) Category XXI Determination Number. According to the Notice, the proposal is “to add a conditional data element, DDTC Category XXI Determination Number, when ‘21’ is selected in the DDTC USML Category Code field in the Automated Export System (AES) to represent United States Munitions List (USML) Category XXI.”

The Notice also proposes “remedial changes” to certain International Traffic in Arms Regulations (ITAR)-related data elements in the Foreign Trade Regulations (FTR).

Comments can be submitted through July 3, 2023.
