CBP Publishes Guidance on Energy and Energy Resources from Canada

In a Cargo Systems Messaging Service (CSMS) bulletin published on March 19, 2025, U.S. Customs and Border Protection provided guidance to the trade on how additional tariffs will be applied to energy and energy resources from Canada.

Energy and energy resources that qualify to be imported into the United States under the United States-Mexico-Canada Agreement (USMCA) will not be subject to any additional tariffs.

The energy and energy products that are products of Canada and do not qualify for USMCA will be subject an additional 10% duty under the harmonized tariff schedule (HTS) number 9903.01.13.

The CSMS includes an attachment that lists all of the products and their respective HTS classifications that will be considered energy and energy resource products.

CBP also reminds the trade that importers may request a classification ruling from CBP to determine “whether goods classified under other HTS classifications fall under the definition of energy and energy resources under HTS 9903.01.13.”
