CBP Proposes Rule to Ban Trade Remedy Goods from de Minimis

In a notice published in the Federal Register on January 21, 2025, U.S. Customs and Border Protection (CBP) announced a proposed rule to make goods subject to “specified trade or national security actions” ineligible to be entered under de minimis programs.

The proposed rule specifically names Section 232, Section 201, and Section 301 as the “specified trade or national security actions” and would have to be entered as a formal or informal entry to ensure collection of those trade remedy duties.

This proposed rule also requires all de minimis entries and international mail packages to require the 10-digit Harmonized Tariff Schedule (HTS) code to ensure that goods could enter the United States under this program.

CBP is accepting public comments on this proposed rule until March 24, 2025, through the Federal eRulemaking Portal at https://www.regulations.gov.
