CBP Issues Section 301 Guidance on Exclusions and Extensions

On May 27, 2020, in Cargo Systems Messaging Service (CSMS) #42839255, U.S. Customs and Border Protection (CBP) issued guidance on the extension of certain Section 301 Tranche 1 exclusions.  These extensions are outlined in Federal Register Notice (FRN) 85 FR 29503 and will be effective through December 31, 2020.  They include 2 full product exclusions and 11 description based exclusions under 9903.88.08 including:

  • Certain filtering equipment;
  • Certain metering spools; and
  • Certain steel poles.

On May 27, 2020, in CSMS #42837261, CBP issued guidance on the fourth round of exclusions for Section 301 Tranche 4A that was announced in 85 FR 28693.  These exclusions are effective from September 1, 2019 through September 1, 2020.

The exclusions cover 3 full 10-digit subheadings and 5 descriptions, addressing 27 exclusion requests.  Product descriptions include, but are not limited to:

  • Certain Bluetooth tracking devices;
  • Certain tumblers; and
  • Certain disposable plastic identification wristbands.
