CBP Issues Updated Guidance on Section 201 Modifications

On October 28, 2020, in Cargo Systems Messaging Service (CSMS) #44583265, U.S. Customs and Border Protection (CBP) issued updated guidance on the modifications of the Section 201 Action on Solar Cells and Panels. The modifications included an adjustment to the duty rate for the safeguard measures from 15% to 18% and the revocation of the exclusion for bifacial panels, but the U.S. Court of International Trade (CIT) granted a temporary restraining order for the bifacial panel exclusion.

These modifications were announced in a Presidential Proclamation on October 10, 2020, in Federal Register Notice 85 FR 65639. The duty rate change is effective beginning February 7, 2021. The bifacial panel exclusion revocation will not be enforced by CBP until further notice.
