CBP Issues Guidance for Section 232 on Ch. 98 Claims

On April 13, 2020, in Cargo Systems Messaging Service (CSMS) #42355735, U.S. Customs and Border Protection (CBP) issued guidance on products being imported under the provisions of Chapter 98 of the Harmonized Tariff Schedule of the United States that also fall under the scope of Section 232 of the Trade Expansion Act of 1962.

The Chapter 98 treatment will be applied, but the Section 232 duties will be assessed independently of the Chapter 98 claim.  When the Chapter 98 provision assesses duty on a portion of the article, such as the repair value, the Section 232 duties will be assessed on that value.  9802.00.60 is an exception and Section 232 duties are required on the entire value of the article.
