On May 2, 2017 U.S. Customs and Border Protection (CBP) released Cargo Systems Messaging Service (CSMS) #17-000253 announcing the enforced Harmonized Tariff Schedule (HTS) flagging for all Environmental Protection Agency (EPA) programs.

According to the notice, once the flags go into effect, they must either be disclaimed or filed with the correct EPA information using the PGA message set. The EPA also notes, “The importer is responsible for knowing what to file, regardless of whether a tariff code has been flagged.”

The EPA tariff flags will go into effect on May 18, 2017.
