In a Federal Register Notice (FRN) published on May 2, 2025, the Bureau of Industry and Security (BIS) published an interim final rule that announced the process for adding new classifications to the Section 232 steel and aluminum derivatives duties that were implemented by Executive Order on February 10, 2025.
BIS will open a submission window at the beginning of May, September, and January of each year. These windows will last for two weeks, and at closing, the agency will post non-confidential versions of all valid requests for a 14-day public comment window. Within 60 days of receiving the request, BIS will publicly announce whether the request was approved and provide a summary of the rationale for its decision.
The FRN also reviews the complete submission process, including all the information required for a submission, how to format the request, and instructions on filing.
This interim final rule went into effect on April 30, 2025, and BIS must receive comments by June 16, 2025.
The first window for submitting requests to add steel and derivatives to Section 232 opened on May 1, 2025.
