BIS Announces Section 232 Exclusion Process Changes

On December 14, 2020, in an interim final rule, the Department of Commerce’s Bureau of Industry and Security (BIS) announced changes to the process for requesting exclusions from the additional duties and quantitative limits on imports of aluminum and steel imposed under Section 232 of the Trade Expansion Act of 1962.

The three main changes to the process addressed in this interim final rule are:

  • The creation of General Approved Exclusions (GAEs) that do not include quantity limits and apply to all importers;
  • The addition of a new certification requirement for requested volumes; and
  • The standardization of the time given to produce steel or aluminum articles for both U.S. objectors and foreign suppliers.
