Argentina Publishes Decree to Promote Customs Code Deregulation

On December 20, 2023, The Argentinian government published Decree 70/2023 to promote a wide deregulation of commerce, industry, and services. This Decree covers a wide range of areas that include but are not limited to economic deregulation, the justice system, energy regulation, reducing corruption, and state intervention involving international trade. Some of the most impactful changes related to international trade include:

  • Waiving the obligation to use the services of a customs broker to file imports or exports.
  • Removes the need for importers and exporters to be listed in a specific registry.
  • Opens the possibility for advance filings,
  • When customs presume a shipment has committed a possible infraction, they must first release the cargo before continuing with their investigation.
  • Advance rulings in different areas such as classification, origin, value, etc.
  • Clarifies presidential prohibitions and faculties.

Decree 70/2023 became effective on December 29, 2023.
