USTR Opens Section 301 Exclusion Portal for Certain Machinery

In a Federal Register Notice (FRN) published on October 17, 2024, the Office of the United States Trade Representative (USTR) announced the creation of a web portal to request temporary exclusion from Section 301 duties for “certain machinery used in domestic manufacturing.”

Each exclusion request must identify a particular product under chapter 84 or 85 Harmonized Tariff Schedule of the United States (HTSUS), provide rationale for the exclusion, and provide information on how the product will be used. Once a request has been submitted, interested persons will have 30 days to comment on the request.

The Section 301 exclusion portal was opened on October 15, 2024. The deadline for exclusion request submissions is March 31, 2025, at 11: 59 p.m. EST.
