USTR Launches Section 301 Investigation on China Phase One Agreement

In a press release published on October 24, 2025, the Office of the United States Trade Representative (USTR) announced a Section 301 investigation into China’s implementation of the “Economic and Trade Agreement Between the Government of the United States of America and the Government of the People’s Republic of China” (Phase One Agreement).

This investigation will “examine whether China has fully implemented its commitments under the Phase One Agreement, the burden or restriction on U.S. commerce resulting from any non-implementation by China of its commitments, and what action, if any, should be taken in response.”

The USTR will be accepting written comments at https://comments.ustr.gov/s/ from October 31, 2025, until December 1, 2025. A formal hearing on the investigation will be held on December 16, 2025.
