USTR Issues Additional Exclusions for Medical Supplies

On March 12, 2020, the Office of the U.S. Trade Representative (USTR) issued two notices announcing exclusions on products of Chinese origin subject to the third and fourth rounds of Section 301 tariffs.

The exclusions cover 5 10-digit subheadings from List 3 and 19 product descriptions from List 4A, addressing 114 exclusion requests.  These exclusions cover medical products including:

  • Certain surgical drapes;
  • Disposable shoe covers;
  • Blood pressure sleeve cuffs; and
  • Certain woven gauze sponges.

The List 3 exclusions are retroactive to September 24, 2018 and will be valid through August 7, 2020.  They can be claimed under 9903.88.41.

The List 4A exclusions are retroactive to September 1, 2019 and will be valid through September 1, 2020.  They can be claimed under 9903.88.42.
