In a press release published on September 13, 2024, the Office of the United States Trade Representative (USTR) announced the final modifications concerning the four-year review of the Section 301 investigation of the “People’s Republic of China’s (PRC) Acts, Policies, and Practices Related to Technology Transfer, Intellectual Property, and Innovation.”
The original modifications proposed in May 2024 were “largely adopted.” However, this final modification includes new timing and rates for tariffs on “face masks, medical gloves, needles, and syringes”. Exclusions for enteral syringes and ship-to-shore cranes were also included, as ordered prior to May 14, 2024.
The USTR expects to launch the machinery exclusions process and open a comment period for proposed changes to tariff rates on “certain tungsten, wafers, and polysilicon tariff lines” soon.
Tariff increases for 2024 will take effect on September 27, 2024, and for 2025 and 2026 on January 1 of the corresponding year.
