CPSC Issues Final Ruling on Exceptions For Lead Limits on Certain Toys

On a Federal Register notice published on July 10, 2013, the Consumer Product Safety Commission (CPSC) issued a final rule amending its current regulations regarding procedures and requirements for the exclusion from lead limits for children's toys, which were updated on August 12, 2011 and are located under section 101(b) of the Consumer Product Safety Improvement Act of 2008 (CPSIA).

In the final rule, CPSC explains that "Under section 101(a) of the CPSIA, consumer products designed or intended primarily for children 12 years old and younger that contain lead content in excess of 100 ppm are considered to be banned hazardous substances under the Federal Hazardous Substances Act (FHSA). "

This final rule amends the current CPSC regulations located in 16 CFR 1500.90 by setting forth procedures for granting said exemption from lead limits based on the function of the products.
