New Critical Circumstances Determination Announced for Thermoformed Molded Fiber Products

On March 14, 2025, in a Federal Register Notice (FRN), the International Trade Administration (ITA) announced the preliminary critical circumstances determination for countervailing duty (CVD) Thermoformed Molded Fiber Products From the Socialist Republic of Vietnam CVD cases (C-552-846).

A finding of critical circumstances allows the Department of Commerce (DOC) and the U.S. International Trade Commission (ITC) to offset possible import surges in the early stages of an AD/CVD investigation.

The critical circumstances finding gives DOC the authority to order the retroactive suspension of liquidation for entries either 90 days before the effective date of the first liquidation suspension, or the date the investigation initiation determination was published to the Federal Register. Cash deposits are due retroactively on any entries under the scope of the CVD case within the critical circumstances date range.

For the Thermoformed Molded Fiber Products From the Socialist Republic of Vietnam CVD cases (C-552-846), a critical circumstances determination has been made effective from DATE. Entries from January 1, 2023, through December 31, 2023, that have not been liquidated require a post summary correction to claim the CVD case if the product falls under the scope.
