EU Imposes Definitive Countervailing Duty on Battery Electric Vehicles

In a press release published on October 29, 2024, the European Commission announced Regulation (EU) 2024/2754, which imposes a definitive countervailing duty on imports of battery electric vehicles designed for the transport of persons originating in the People’s Republic of China.

This new countervailing duty will apply to TARIC code 8703.80.10.10, and the rate of duty will range from 7.8% to 35.3% based on the exporting producer of the product.

Importers may request a refund if they believe their exporting producer is not subsidized or if their subsidy margin is less than the duties paid by the importers. Such a request should be duly substantiated and supported by the respective evidence.

This countervailing duty went into effect on October 30, 2024, and will be applicable for five years.
