EPA Issues New Use Rules for 35 Chemicals under TSCA

In a Federal Register Notice (FRN) published on November 4, 2025, the Environmental Protection Agency (EPA) announced it was issuing significant new use rules (SNURs) under the Toxic Substances Control Act (TSCA) for 35 chemical substances.

These SNURs require “persons to notify EPA at least 90 days before commencing the manufacture (defined by statute to include import) or processing of any of these chemical substances for an activity that is designated as a significant new use in the SNUR.”

Manufacturing or processing these chemicals for significant new uses cannot begin until the EPA reviews the notification, makes a determination, and acts accordingly.

Importers of chemical substances in bulk form are required to certify that the shipments of chemical substances comply with all “applicable rules and orders under TSCA, including regulations issued under TSCA sections 5, 6, 7 and Title IV.”

These SNURs will enter effect on January 5, 2026.
