In a Federal Register Notice (FRN) published on January 13, 2025, U.S. Customs and Border Protection proposed a rule that would require the electronic submission of export manifest data for rail cargo departing the United States.
This data would need to be submitted by the outbound carrier or another “eligible party” such as the U.S. principal party in interest, the freight forwarder, non-vessel operating common carrier, or customs broker.
The following data elements would be required to be submitted at least 24 hours before the cargo departs:
- Bill of lading number;
- Total quantity of cargo;
- Total weight of cargo;
- A “precise” cargo description
- Shipper’s complete name and address;
- Consignee’s complete name and address; and
- The Automated Export System (AES) Exemption Statement, if applicable.
All other data elements, whether optional or mandatory would be required to be transmitted two hours prior to departure.
The proposed rule is accepting comments through the Federal eRulemaking Portal through March 14, 2025.
