CBP Issues Instructions on Section 301 Product Exclusions During Government Shutdown

Posted by Matt Schmitt on 1/3/19 5:00 PM

On December 31, 2018, U.S. Customs and Border Protection (CBP) announced they would not implement the updates to the Automated Commercial Environment (ACE) to include Section 301 product exclusions during the government shutdown in Cargo Systems Messaging Service (CSMS) #18-000757.

According to CBP, instructions and entry guidance will be issued at the conclusion of the government funding hiatus and, the Section 301 product exclusions will be updated into ACE 10 business days after the hiatus has ended. CBP advises importers not to use the Chapter 99 product exclusion number, as ACE will reject entries and entry summaries until the product exclusions are implemented. Importers may file a Post Summary Correction or file a protest once CBP issues guidance and implements the ACE enhancements.

CBP directs questions related to Section 301 entry filing requirements to traderemedy@cbp.dhs.gov.
