CBP Amends Title 19 Code of Federal Regulations to Align with Trade Facilitation and Trade Enforcement Act (TFTEA)

In a Federal Register notice published on June 8, 2017 U.S. Customs and Border Protection (CBP) issued a final rule advising that Title 19 of the Code of Federal Regulations (CFR) at 19 CFR 12.42-12.45, “Merchandise Produced by Convict, Forced, or Indentured Labor” will be amended to remove the “consumptive demand” clause as outlined by TFTEA.

The “consumptive demand” clause, previously located in the Tariff Act of 1930, permitted certain forced-labor-derived goods into the U.S., if the U.S. did not produce enough of the good to meet the “consumptive demands” of the U.S.

TFTEA section 910 removed the “consumptive demand” clause from the Tariff Act, which became effective on March 10, 2016. CBP will now have the 19 CFR amended to reflect the amendment and will continue to enforce the amendment as they have since it came into effect.

This final rule became effective on June 8, 2017.
