BIS Suspends Affiliate Entities Rule for One Year

In a Federal Register Notice (FRN) published on November 12, 2025, the Bureau of Industry and Security (BIS) announced a one-year suspension of the “Expansion of End-User Controls to Cover Affiliates of Certain Listed Entities” interim final rule that was published September 30, 2025.

Under this rule, “any entity that is at least 50 percent owned directly or indirectly, individually or in the aggregate, by one or more entities on the Entity List, or by unlisted entities that are subject to license requirements or other restrictions based upon their ownership, is itself automatically subject to Entity List restrictions.”

The affiliates rule and all changes to the Export Administration Regulations (EAR) made due to the affiliates rule will be suspended from November 10, 2025, to November 9, 2026.
