BIS Seeks Comments on Foundational Technologies

On August 27, 2020, in a Federal Register Notice (FRN), the Department of Commerce’s Bureau of Industry and Security (BIS) published an Advance Notice of Proposed Rulemaking (ANPRM) to address the “foundational technologies essential to the national security…that may warrant stricter controls if a present or potential application or capability of that technology poses a national security threat.”

BIS is seeking comments on eight aspects of foundational technologies, including:

  • How to define them;
  • Criteria for identification; and
  • The potential impact of controls on the development of these technologies.

Comments are due October 26, 2020.
