BIS Requests Public Comments on Amending Export Regulations for Electronic Waste

On October 23, 2018, the Department of Commerce’s Bureau of Industry and Security (BIS) announced in a Federal Register Notice (FRN) that it is seeking public comments on the effects and costs of amending its regulations to reflect new export controls regarding electronic waste.

Some of the potential regulatory changes that BIS is seeking comments on include:

  • A contemplated new definition of electronic waste;

  • A potential prohibition on electronic waste exports;

  • Exemptions from the potential prohibition of electronic waste exports;

  • A regulatory change in reporting requirements for the exports of exempted electronic waste;

  • A new recordkeeping requirement;

  • The cost to industry for the potential changes to the regulations.

Comments may be submitted to the Federal rulemaking portal at www.regulations.gov and should use the ID BIS-2018-0022. Comments must be received by BIS no later than December 24, 2018.
