BIS Releases Hong Kong Support Documentation Requirements

In a Federal Register Notice (FRN) published on January 19, 2017 the Bureau of Industry and Security (BIS) announced updated support documentation requirements necessary for certain shipments to and from Hong Kong.

According to the notice, any export or reexport to Hong Kong that is subject to the U.S. Department of Commerce’s Export Administration Regulations (EAR) and also listed on the Commerce Control List (CCL) will now be require a Hong Kong import license or, if no license is required, a statement from the Hong Kong government attesting to this.  This applies to items of, “national security (NS), missile technology (MT), nuclear nonproliferation (NP column 1), or chemical and biological weapons (CB)”. 

 This same rule applies to reexports from Hong Kong. An export license must be obtained or a government statement stating that no license is required.

The rule will become effective on April 19, 2017.
