In two Federal Register notices to be published on July 31, 2014, the Department of Commerce is making a preliminary affirmative antidumping determination that certain crystalline silicon photovoltaic products from the People’s Republic of China (PRC) and Taiwan are being sold in the U.S. at less than market value, and consequently will impose additional duties effective July 31, 2014.
The preliminary dumping rates for China include the following:

The following certification requirements will also apply:
- If an importer imports solar panels/modules that it claims do not contain solar cells that were produced in China/Taiwan, the importer is required to maintain an importer certification
- The importer and exporter are required to maintain an exporter certification if the exporter of the panels/modules for which the importer is making the claim is located in China/Taiwan.
- If a solar panel/module assembled in China/Taiwan contains solar cells manufactured in third countries using ingots, wafers, or partially produced solar cells manufactured in China/Taiwan, but the importer is unable to identify the total value of the panel/module subject to provisional measures, the Department intends to instruct CBP to suspend all unliquidated entries for which the importer has failed to supply this information.
