CBP Announces New AD/CVD Duty Evasion Regulations

In a Federal Register Notice (FRN) to be published on August 22, 2016 U.S. Customs and Border Protection (CBP) will announce an interim rule that will define the formal process for CBP to research claims of evasion of antidumping and countervailing duty orders.

This interim rule is being implemented to align with the Enforce and Protect Act of 2015 (EAPA) contained in Title IV of the Trade Facilitation and Trade Enforcement Act of 2015 (TFTEA). The new procedures include implementing specific timeframes, ways of collecting information, and determination requirements that CBP must follow when investigating AD/CVD evasion orders.

The AD/CVD interim rule will become effective on the date of publication in the Federal Register, while comments must be received within 60 days of the date of publication.
