Colombia Publishes Updated Penalty and Confiscation Regime in Customs Matters

On June 6, 2023, Colombia´s Ministry of Revenue and Public Credit and the Ministry of Tourism, Industry and Commerce published Decree 0920 of 2023 introducing changes in the regime of penalties and confiscation in customs matters. These changes include concepts such as minimum penalty amount, admonition, fine reductions, Apprehensions Review Committee, Customs Violations by different parties, and changes in the defense process. The entry into force was June 9, 2023.

The purpose of this decree is to establish the provisions that constitute the sanctioning regime and seizure of merchandise in customs matters, as well as the applicable procedures followed by authorities.
