CBP Issues Section 301 Guidance on Exclusions and Extensions

On June 15, 2020, in Cargo Systems Messaging Service (CSMS) #43043838, U.S. Customs and Border Protection (CBP) issued guidance on the extension of certain Section 301 Tranche 1 exclusions.  These extensions are outlined in Federal Register Notice (FRN) 85 FR 33775 and will be effective through December 31, 2020.  They include 16 description based exclusions originally under 9903.88.10 including:

  • Certain pumps;
  • Certain motors and parts; and
  • Certain solar water heaters.

9903.88.10 expired June 4, 2020, but the extended exclusions can be claimed under 9903.88.50 through their expiration in December.

On June 15, 2020, in CSMS #43044185, CBP issued guidance on the 14th round of exclusions for Section 301 Tranche 3 that was announced in 85 FR 32094.  These exclusions are effective from September 24, 2018 through August 7, 2020.

The exclusions cover 17 full 10-digit subheadings and 61 descriptions, addressing 70 exclusion requests.  Product descriptions include, but are not limited to:

  • Various types of shrimp;
  • Various craft kits; and
  • Various chemicals.

They can be claimed under 9903.88.48.
