CBP Issues Guidance on Submitting Imports of Products Excluded from Section 301 Duties

On February 8, 2019, U.S. Customs and Border Protection (CBP) issued instructions for filing entries that are subject to the Section 301 product exclusions, in Cargo Systems Messaging Service (CSMS) #19-000052.

CBP instructs importers to report the Harmonized Tariff Schedule of the U.S. (HTSUS) 9903.88.05 classification in addition to the regular chapter 84, 85, and 90 HTSUS classification. The duty exclusions are retroactive to July 6, 2018 and importers may file post summary corrections to request refunds for entries that have not liquidated. For entries that have already liquidated, importers may file protests.

The functionality in the Automated Commercial Environment went into effect on February 10, 2019. CBP directs further questions related to Section 301 entry filing requirements to be emailed to Traderemedy@cbp.dhs.gov.
