CBP Issues Guidance for Perfecting Drawback Claims for Section 301 and Section 201 Duties

On February 8, 2019, U.S. Customs and Border Protection (CBP) published a Cargo System Messaging Service (CSMS) #19-000050 providing guidance for filers to “perfect” a claim on duty drawback for Section 201 and Section 301 duty.

According to the CSMS, filers will no longer receive an error message relating to the unit of measurement mismatch. Additionally, filers are required to “perfect” a claim for any previously filed and accepted claim subjected to Section 301 or Section 201 duties. In order for filers to “perfect” a claim, CBP advises they must, “…contact their Drawback Specialist and request the claim be returned to trade control.” The filers are then required to list both the chapter 99 and the associated chapter 1 to 97 Harmonized Tariff Schedule numbers on their claim and resubmit to CBP within 5 business days.
