USTR Announces New Exclusions on Lists 1 and 3 of the Section 301 Tariffs

On December 12, 2019, the Office of the U.S. Trade Representative (USTR) issued notices announcing additional exclusions on products of Chinese origin subject to the first and third lists of Section 301 tariffs.

The List 1 exclusion covers products classified under 9030.90.4600 and is retroactive to July 6, 2018 and will be valid through October 1, 2020.  They can be claimed under 9903.88.19.

The List 3 exclusions cover 35 product descriptions, addressing 75 separate exclusion requests.

Product descriptions listed include, but are not limited to:

  • Various fruits;
  • Certain calculators; and
  • Certain wood products.

The List 3 exclusions are retroactive to September 24, 2018 and will be valid through August 7, 2020.  They can be claimed under 9903.88.36.
