U.S. President Donald Trump Signs Executive Memo on Section 301 Investigation

On March 22, 2018, U.S. President Donald Trump signed a Presidential Memorandum regarding the results of a Section 301 Investigation of “China’s Laws, Policies, Practices, or Actions Related to Technology Transfer, Intellectual Property, and Innovation.”

The Memorandum details the results of the investigation and directs the United States Trade Representative to take the following actions, including but not limited to:

  • Publish a list of products and proposed tariff increases within 15 days of the date of the memorandum;
  • Pursue dispute settlement in the World Trade Organization (WTO) in cooperation with other members of the WTO and report on the progress within 60 days of the date of the memorandum.

The Section 301 investigation was completed under the Trade Act of 1974, which provides for a comment period of not less than 30 days before the USTR makes determinations under 19 U.S.C. §2414.
