EPA Determines the TSCA Chemical Reporting Requirements for Small Businesses Warrant Changes

On November 30, 2017, the Environmental Protection Agency (EPA) issued in a Federal Register Notice its final determination that revisions of current size standards used in the Toxic Substances Control Act (TSCA) section 8(a)(1) and 8(a)(3) are warranted for small businesses. The preliminary determination was issued December 15, 2016.

The potentially affected entities may include:

  • Basic Chemical Manufacturers;
  • Resin, Synthetic Rubber, and Artificial Synthetic Fibers and Filament Manufacturers;
  • Pesticide, Fertilizer, and Other Agricultural Chemical Manufacturers;
  • Paint, Coating, and Adhesive Manufacturers;
  • Other Chemical Product and Preparation Manufacturers, and
  • Petroleum Refineries.

The EPA will address the revisions to the size standards in a future publication.
