On November 3, 2017, the U.S. Customs and Border Protection (CBP) issued updated guidelines on liquidated damages and penalties for non-compliant Wood Packaging Material (WPM).

The guidelines cover proper marking of WPM, exceptions, exemptions, liquidated damages, and penalties, and describe three categories of WPM enforcement:

  • WPM that is unmarked;
  • WPM that is inappropriately marked, and
  • WPM that is infested.
