Argentina Publishes Requirements on the Sworn Declaration of Product Composition

On May 2nd,2018, the Argentina government published through the Official Bulletin, Resolution 246/2018. The resolution modifies Resolution 404/2016, replacing Section 5 which, contains the classification of products subject to the submission and procurement of a Sworn Declaration of Product Composition. This is also known as DJCP for its acronym in Spanish, “Declaración Jurada de Composición de Producto.” Section 5 contains 963 statistical breakouts from the Mercosur Common Nomenclature that ranges from Chapters 50 to 65 and a couple of items from chapter 94.

The articles covered in these chapters cover goods made with:

  • Silk;
  • Cotton;
  • Wool;
  • Synthetic fibers;
  • Fabrics;
  • Textiles;
  • Apparel clothing;
  • Footwear and hats.

The DJCP will be valid for 180 days from the approval date and the importer or manufacturer may request the renewal of the validity period of the DJCP within 45 to 15 days before the expiration date when the data contained in the Declaration remains the same. If the data on the original DJCP must be modified or if the renewal has not been requested within the periods established, a new DJCP application must be generated. Additionally, the DJCP must be valid at the moment of the first commercial operation after the nationalization.

The DJCP submitted on the SISCO system should not be submitted to the Secretary of Commerce.

During a one-year period, the number of acceptance issued by the SISCO system and the description of the goods will not be required in the commercial documents.

The submission of a laboratory test report that supports the content of the Product Composition Affidavit (DJCP) will not be mandatory, but randomly as required by the application authority. It is not required the INTI report but it must be a report with the same information that the INTI informs in the essays and it must be done by a laboratory.

The Resolution 246/18 went into force on May 4, 2018.
